El fiscal general de Nueva York, Eric T. Schneiderman, ha presentada una demanda contra varios de los mayores bancos del país, a los que acusa de proporcionar información "falsa y engañosa" para llevar a cabo ejecuciones hipotecarias "fraudulentas", según informó en un comunicado.
En concreto, Schneiderman menciona en su demanda a JPMorgan Chase Bank, Bank of America y Wells Fargo Bank, así como a Merscorp y sui subsidiaria Mortgage Electronic Registration Systems.
El fiscal señala que la creación del uso de un sistema de registro electrónico de hipotecas privadas nacionales, conocido como MERS, se ha traducido en una amplia serie de ejecuciones hipotecarias "fradulentas y engañosas", perjudicando a los propietarios y socavando la integridad del proceso judicial de ejecuciones.
La demanda afirma que los empleados y agentes de Bank of America, J.P. Morgan Chase y Wells Fargo, que actuaron como "agentes certificados por el MERS", presentaron en repetidas ocasiones documentos en los juzgados que contenían información falsa y engañosa que hacían parecer que existía permiso para el embargo cuando no era así.
Schneiderman apunta que los bancos crearon el sistema MERS en 1995 con el fin de ser un sistema de registro de la propiedad que facilitará una rápida titulización y venta de hipoteas. Sin embargo, luego presentaron demandas de ejecución hipotecaria "en masa" basadas en información fraudulentwa y engañosa, que buscaba echar de sus casas a la gente "con poro respecto a los requisitos legales básicos".
